1. Acceptance of Terms

By accessing and using ModuHomes' website, services, or purchasing our products, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you disagree with any part of these terms, you may not access our services or make purchases.

We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance of the modified terms. It is your responsibility to review these terms periodically for updates.

2. Services Overview

ModuHomes provides modular housing and office solutions including:

• Design and customization of modular structures
• Manufacturing of modular units
• Delivery and installation services
• Maintenance and support

All services are subject to availability and may vary by location. Specific terms for each service will be outlined in individual service agreements or purchase contracts.

3. Ordering Process

The purchase process for ModuHomes products involves:

1. Consultation: Initial discussion of requirements and site evaluation
2. Quotation: Provision of a detailed price estimate
3. Design Approval: Review and approval of customized designs
4. Contract: Signing of a formal purchase agreement
5. Deposit: Payment of initial deposit (typically 30%)
6. Manufacturing: Production of your modular units
7. Balance Payment: Payment of remaining balance upon completion
8. Delivery/Installation: Transportation and assembly at your site

Lead times vary by model and customization level, typically ranging from 30-90 days from contract signing to installation.

4. Pricing and Payments

All prices are in Indian Rupees (₹) and subject to change without notice until a formal contract is signed. Pricing may vary based on:

• Model selection and customization
• Site-specific requirements
• Geographic location and transportation costs
• Market fluctuations in material costs

Payment terms are as follows:

• 30% deposit upon contract signing
• 40% upon completion of manufacturing
• 30% upon completion of installation

Late payments may incur interest charges of 1.5% per month. We accept bank transfers, credit/debit cards (subject to processing fees), and demand drafts.

5. Cancellation and Refund Policy

Cancellation terms depend on project stage:

• Pre-manufacturing: Full refund of deposit minus ₹25,000 consultation/design fee
• During manufacturing: 50% of deposit refundable if cancellation occurs before 50% completion
• Post-manufacturing: No refunds available

Custom orders cannot be returned or exchanged unless defective. Refunds are processed within 30 days of cancellation request.

6. Warranties

ModuHomes provides the following warranties:

• Structural: 10 years against major defects in framing and load-bearing components
• Weatherproofing: 5 years against leaks and moisture intrusion
• Systems: 2 years for electrical and plumbing systems
• Finishes: 1 year for interior and exterior finishes

Warranties are transferable to subsequent owners and cover defects in materials and workmanship when properly maintained. They do not cover damage from:

• Natural disasters or extreme weather events
• Improper maintenance or modifications
• Accidental damage or vandalism
• Normal wear and tear

Warranty claims must be submitted in writing with supporting documentation.

7. Delivery and Installation

Standard delivery includes transportation to your site within 200km of our Maharashtra facility. Additional charges apply for:

• Long-distance transportation
• Specialized equipment requirements
• Remote or difficult-to-access locations

Customers are responsible for:

• Obtaining all necessary permits
• Site preparation (leveling, foundation)
• Utility connections (unless included in contract)

Delivery dates are estimates only and not guaranteed. We are not liable for delays caused by factors beyond our control including weather, transportation issues, or labor disputes.

8. Intellectual Property

All ModuHomes designs, blueprints, and technical specifications remain our intellectual property even after purchase. Customers receive:

• License to use the design for their specific unit
• As-built drawings for maintenance purposes

You may not:

• Reproduce, modify, or distribute our designs
• Use our designs to construct additional units
• Reverse engineer our modular systems

Website content, including text, images, and logos, is protected by copyright and may not be used without permission.

9. Limitation of Liability

To the maximum extent permitted by law, ModuHomes shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or business opportunities
• Property damage not caused by our negligence
• Issues arising from improper site preparation or maintenance

Our total liability for any claim related to our products or services shall not exceed the purchase price paid for the specific product or service giving rise to the claim.

10. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved as follows:

1. Negotiation: Parties will attempt to resolve disputes amicably through good-faith negotiations for 30 days.
2. Mediation: If unresolved, parties will attempt mediation with a mutually agreed mediator in Maharashtra.
3. Arbitration: If mediation fails, disputes will be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996.
4. Litigation: As a last resort, parties may pursue claims in courts located in Thane, Maharashtra.

Notwithstanding the above, we reserve the right to seek injunctive relief in courts of competent jurisdiction to protect our intellectual property or prevent irreparable harm.

11. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

12. General Provisions

Severability: If any provision of these terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

Waiver: Failure to enforce any right or provision will not constitute a waiver of future enforcement.

Assignment: Customers may not assign their rights or obligations without our written consent. We may assign our rights to any affiliate or successor entity.

Entire Agreement: These terms, along with any signed contracts, constitute the entire agreement between parties regarding the subject matter.
